NORMATIVA

La JURECH está regida por las siguientes leyes y normativas existentes en el país:

Constitución de la República del Ecuador en su art. 12 que resalta el derecho humano al agua como fundamental e irrenunciable, así mismo como patrimonio nacional estratégico de uso público, inalienable, imprescriptible, inembargable y esencial para la vida.

Art. 318.- El agua es patrimonio nacional estratégico de uso público, dominio inalienable e imprescriptible del Estado, y constituye un elemento vital para la naturaleza y para la existencia de los seres humanos. Se prohíbe toda forma de privatización del agua.

La gestión del agua será exclusivamente pública o comunitaria. El servicio público de saneamiento, el abastecimiento de agua potable y el riego serán prestados únicamente por personas jurídicas estatales o comunitarias.

El Estado fortalecerá la gestión y funcionamiento de las iniciativas comunitarias en torno a la gestión del agua y la prestación de los servicios públicos, mediante el incentivo de alianzas entre lo público y comunitario para la prestación de servicios.

El Estado, a través de la autoridad única del agua, será el responsable directo de la planificación y gestión de los recursos hídricos que se destinarán a consumo humano, 

riego que garantice la soberanía alimentaria, caudal ecológico y actividades productivas, en este orden de prelación.

Se requerirá autorización del Estado para el aprovechamiento del agua con fines productivos por parte de los sectores público, privado y de la economía popular y solidar de acuerdo con la ley.

A su vez, la LEY ORGÁNICA DE RECURSOS HÍDRICOS, USOS Y APROVECHAMIENTO DEL AGUA (LORHUYA) en su Art. 47.- describe a las Juntas de Riego, como organizaciones comunitarias sin fines de lucro que tienen por finalidad la prestación del servicio de riego y drenaje, bajo criterios de eficiencia económica, calidad en la prestación del servicio y equidad en la distribución del agua.

EI REGLAMENTO A LA LEY ORGÁNICA DE RECURSOS HÍDRICOS, USOS Y APROVECHAMIENTO DEL AGUA en Art. 40 también se refiere a las Juntas de Riego las cuales deben reconocer y aplicar el derecho humano al agua de acuerdo como se regula en la Ley y su Reglamento.

De igual forma, en el CAPÍTULO II de este reglamento se habla sobre el INSTRUCTIVO PARA CONFORMACIÓN Y LEGALIZACIÓN DE JUNTAS DE RIEGO Y/O DRENAJE las cuales se conformara con un mínimo de cinco miembros, en base a la normativa vigente; la Secretaría de Agua promoverá e incentivará la asociatividad de beneficiarios.

ESTRUCTURA

«La JURECH está conformada por 100 juntas locales aglutinadas en una Junta General; dichas Juntas Locales se encuentran representadas por una Directiva elegida a través de Asambleas de Usuarios.

El órgano directivo de La Junta Generales su directorio conformado por: Presidente, Vicepresidente, Secretario, Tesorero y ocho vocales correspondientes a cada una de las zonas del sistema de riego, su trabajo se enfoca en generar las condiciones que garanticen la prestación del servicio de riego a través de sus cinco ejes de acción: Administrativo, Legal, Técnico, Social y Productivo.

Operativamente la JURECH cuenta con una estructura orgánica liderada por el Presidente de la Junta General como representante del Directorio, un Administrador y tres unidades: Administrativa, de Operación y Mantenimiento y de Gestión y Apoyo.»
